RightCount Applauds Georgia Attorney General’s Opinion Rejecting Investigation of 2020 Election

Atlanta, GA: RightCount, an organization dedicated to rebuilding trust in Georgia’s secure election system, today released the follow statement from Georgia State Chair Eric Johnson. Johnson, a Republican, previously served as State Senate Pro Tempore and Chair of the Senate Ethics Committee.

“Attorney General Chris Carr’s opinion is a win for conservatives who believe in the rule of law. AG Carr confirms that even though some members of the State Election Board might try operating outside of the confines of Georgia law and the Georgia Constitution, his office won’t stand for that. When government actors start acting outside the confines of the law, they threaten our freedom. Further, with all these last-minute changes, a majority of the State Election Board is going to undermine the faith of Georgians in their elections. The last time that happened, the Republicans lost control of the US Senate. I’m glad Attorney General Carr is sticking up for Georgia law and our state Constitution,” said RightCount Co-Chair Eric Johnson.

On Monday, Georgia Attorney General Chris Carr (R) stated that the State Election Board can’t ask his office to investigate Fulton County’s handling of the 2020 presidential election in an official opinion. This action stems from a complaint alleging mass election fraud in Fulton County in the 2020 presidential election.

In his opinion, Carr said the “authority to investigate potential violations of the election laws rests with the [State Election Board] and not with the Attorney General,” and that he is not required to conduct an investigation because a state agency asked his office to. Additionally, he explained the state election code does not empower him to “act on his own as an investigator beyond the limited context of a referral of a case to the Attorney General for potential criminal prosecution.”
